THIS AGREEMENT is made and entered into by and between the Counties of Chatham, Harnett and Wake and the municipalities of Apex, Cary, Durham, Holly Springs, Morrisville, and Sanford, all local government corporations of the State of North Carolina; the Cape Fear Public Utility Authority (“CFPUA”), Lower Cape Fear Water and Sewer Authority (“LCFWASA”) and the Orange Water and Sewer Authority (“OWASA”), authorities created under the laws of the State of North Carolina; and the Public Works Commission of the City of Fayetteville (“PWC”) [collectively referred to herein as the “Participants”]; along with the Triangle J Council of Governments (“TJCOG”) [referred to herein as the “Managing Agent”], created under the North Carolina General Statutes, Chapter 160A, Article 20, Part 2; to be effective from and after July 1, 2008.
