THIS AGREEMENT (hereinafter the “Contract” or the “Agreement”), by and between the People of the State of New York, acting by and through the Commissioner of the Office of General Services (OGS), whose office is on the 41st Floor, Tower Building, Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242 (hereinafter referred to as the “State” or “OGS”) and Metropolitan Foods d/b/a Driscoll Foods, having its principal place of business at 174 Delawanna Avenue, Clifton, New Jersey, 07014 (hereinafter referred to as the “Contractor”). OGS and the Contractor are collectively referred to as the “Parties.”

THIS FIRST AMENDMENT, (the “First Amendment”) is made between the People of the State of New York, acting by and through the Commissioner of the Office of General Services (hereinafter “State” or “OGS”) whose principal place of business is at the Corning Tower, The Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242, pursuant to authority granted under New York State Finance Law §163, and Metropolitan Foods, Inc. D/B/A Driscoll Foods with its principal place of business at 174 Delawanna Avenue, Clifton, New Jersey 07014 (hereinafter referred to as the “Contractor”). The foregoing are collectively referred to as the “Parties”.
