THIS PRE-ANNEXATION AGREEMENT (“Pre-Annexation Agreement”) is entered into this day of June, 2020, by and among KM Real Estate Enterprises LLC and M. Dean & Company, LLC (“Property Owner”) and the CITY OF MOAB, a municipality and political subdivision of the State of Utah (the “City”). Property Owner and the City are hereinafter sometimes referred to individually as a “Party” or collectively as the “Parties.”
