This Three-Party Agreement for Joint Use of a portion of Tract B (this “Agreement”) is entered into between the City of Boulder, a Colorado home rule municipality (“Boulder”), the Northern Colorado Water Conservancy District, a quasi-municipal entity and political subdivision of the State of Colorado (“Northern Water”) and USI COB 63rd WTP LLC, a Delaware limited liability Company (“USI”), each of which is a “Party” and together are the “Parties.”
