This software as a service (SaaS) agreement (including its Annex(es)) (the “Agreement”) contain the terms and conditions that governs the grant of access and use right of the Planon SaaS Services, the provision of Consultancy Services and/or Training Services (each as defined below) from Planon International B.V., a private limited liability company, duly incorporated and existing under the laws of the Netherlands, with its principal office at Wijchenseweg 8, 6537 TL Nijmegen, the Netherlands, registered with trade register under number 09102087 (“Planon”) to the legal entity as identified as “Customer” in the order form (“POF” or “Order Form”) referring to this Agreement (“Customer”) and is an agreement between Planon and the Customer. This Agreement takes effect as of the (effective) date as identified in the (initial) Order Form referring to this Agreement (“Effective Date”).
