This Design-Build Contract (“Contract”) is made and entered into this XXTH day of October, 2010, by and between the CITY OF PALM DESERT (“CITY”), and DESIGN/BUILD CONTRACTOR (the “Design-Build Entity”), for the purpose of designing and constructing the EECBG PHOTOVOLTAIC SYSTEMS PROJECT. The CITY and the Design-Build Entity are herein collectively referred to as the “Parties.”
