Powers in his official capacity as Interim Executive Director of the South Florida Water Management District; and the Florida Department of Environmental Regulation and Carol M. Browner in her official capacity as Secretary of the Florida Department of Environmental Regulation, desire to restore, preserve and protect the unique flora and fauna of the Everglades National Park and the Arthur R. Marshall Loxahatchee National Wildlife Refuge, to maintain a cooperative relationship in accomplishing these goals, and to settle and resolve the disputes that have arisen between and among them without admitting or conceding liability;
