THIS AGREEMENT is made as of this 21st day of January 2006 by and between the Department of Environmental Quality, an agency of the Commonwealth of Virginia (the “DEQ”) and the County of Arlington (the “Grantee”). The Grantee has contracted with a “Project Engineer” to complete an approvable Preliminary Engineering Proposal (“PEP”) and/or planning documents as shown in Exhibit B.
