This Easement has been acquired with funds provided, in part, under the Agricultural Conservation Easement Program (ACEP) 16 U.S.C. Section 3865 et seq. and 7 CFR Part 1468 for the purpose of protecting the agricultural use and future viability, and related conservation values, by limiting nonagricultural uses of the Property that negatively affect the conservation values of the Property (see Section 2 below, defining the “Purposes of the Easement”). Baseline conditions of the Property are set forth in a Baseline Documentation Report, a copy of which is maintained in the files of Grantee and in the office of the Montana NRCS.

THIS GRANT DEED OF CONSERVATION EASEMENT (“Easement”) is made this ____ day of___________, 20__, by SPRING FAMILY FARM, INC., a corporation formed under the laws of the state of Montana, with a mailing address of 3455 Wes Davis Road, Belgrade, MT 59714 (hereinafter together with its successors and assigns collectively referred to in this Easement as the “Grantor”), and GALLATIN VALLEY LAND TRUST, a non-profit Montana corporation with a mailing address of P.O. Box 7021, Bozeman, MT 59771 and a principal office at 212 S. Wallace Ave., Suite 101, Bozeman, Montana 59715, and its successors and assigns (hereinafter referred to as “Grantee”); and with a right of enforcement to the UNITED STATES OF AMERICA (“United States”), acting by and through the United States Department of Agriculture (“USDA”) Natural Resources Conservation Service (“NRCS”) on behalf of the Commodity Credit Corporation (“CCC”).
