THIS CLASS ACTION SETTLEMENT AGREEMENT (the “Agreement”) is made this 19th day of August, 2020 by and between Plaintiffs Sean Miner, David Heumann, and Shawna Admire, on their own behalf and on behalf of the Settlement Class (as defined below) (collectively, “Plaintiffs”), and Deborah J. Caruso, not individually but as the chapter 7 Trustee for the Bankruptcy Estate of ITT Educational Services, Inc., et al. (“Trustee”). Plaintiffs and the Trustee are each a “Party,” and collectively the “Parties.”
