This Data Processing Agreement (“DPA”), effective as of by and between Infor (US), LLC (“Company”) and and its Affiliates (“Vendor”) sets forth the terms and conditions relating to the privacy, confidentiality, security and protection of Personal Data (as defined below) associated with services rendered by, and/or products provided by, Vendor to Company (and/or its Affiliates or customers or where Vendor is a Subprocessor, Company’s customer as Controller) pursuant to any agreement between Vendor and Company (and/or its Affiliates) (collectively, Company and Vendor are the “Parties”), regardless of whether such agreement exists as of or after the Effective Date (such agreement as applicable, the “Services Agreement”, which, together with this DPA, the “Agreement”).
