THIS AGREEMENT is made this day of , 2019, by and between the South Boulder & Coal Creek Irrigating Ditch Company, a Colorado nonprofit corporation (the “Ditch Company”), BC Lanterns Rock Creek LLC, a Colorado limited liability company (“Developer”), and the Town of Superior, a Colorado statutory town (“Town”) (collectively, the “Parties”).
