THIS USE AGREEMENT (the “Agreement”) is made and entered into as of the Effective Date, as that term is defined in Section IX K, below, by and between POLK COUNTY, FLORIDA, a political subdivision of the State of Florida, (the “County”) and the CITY OF WINTER HAVEN, FLORIDA, a Florida Municipal Corporation (the “City”); each singularly a “party” and together, “the parties,” to this Agreement with reference to the following facts and subject to the following terms and conditions.
