This Pre-Annexation Agreement (this “Agreement”) is made and entered into so as to be effective on the last date of signature by a party hereto (the “Effective Date”), by and between M/I HOMES OF CENTRAL OHIO, LLC, an Ohio limited liability company (“M/I”) and the VILLAGE OF MINERVA PARK, OHIO, an Ohio municipal corporation organized and existing under the Constitution and laws of the State of Ohio (“Village”), under the circumstances summarized in the following recitals. M/I and the Village may be referred to herein individually as a “Party” or together as the “Parties”.
