The Developer is the developer of a master planned community located in Washington County, Texas, known as Bluebonnet Ridge Heritage Estates (“Subdivision”). The developer expects to offer certain residential real estate lots in the Subdivision for sale only after qualifying such lots for exemption from the registration requirements under the federal Interstate Land Sales Full Disclosure Act (the “Act”) or otherwise complying with such Act. Prior to the offering of these lots it is the desire of both parties that Reserving Party be permitted to reserve a lot in the Subdivision and to make a fully refundable escrow deposit to be held by (“Escrow Agent”), all under the following terms and conditions:
