This Class Action Settlement Agreement and Release (“Agreement”) is entered into pursuant to Federal Rule of Civil Procedure 23. For the purposes of this Agreement, “Defendant” or “PGAC” refers to Permanent General Assurance Corporation. “Connor” refers to Plaintiff Dorine L. Connor and “Pugh” refers to Plaintiff Myrtle E. Pugh. Plaintiff Connor and Plaintiff Pugh are referred to collectively herein as “Plaintiffs” or “Settlement Class Representatives.” The “Parties” refers, collectively, to PGAC and Plaintiffs.
