I, a duly authorized representative of the applicant for the above-referenced Borough Street Occupancy Permit, hereby fully indemnify and hold harmless and, if requested, will defend the Borough of Shippensburg, the Shippensburg Borough Authority, and their officers, agents, and employees, of and from liability for damages or injury to persons or property in a claim for suit seeking to impose liability on the Borough, the Borough Authority, or their officers, agents, and employees, arising out of an act or omission of a contractor, agent, servant, employee, or person engaged or employed in, about, or upon the work, by, at the instance of, or with the approval or consent of the permittee, including a failure of the permittee or a person to comply with the permit or the regulations referenced by the permit.
