This Option to License Agreement For Fuel Cell Energy Facility Power Purchase and License Agreement (the “Option Agreement”) is made this day of , 20 (the “Effective Date”) by and between the Town of Stratford, Connecticut, a municipal corporation existing under and by virtue of the laws of the State of Connecticut with an address of 2725 Main St, Stratford, CT 06615 (the “Town” or “Owner”), and [Fuel Cell Developer], a [STATE] limited liability company whose principal place of business is located at [ADDRESS] (the “Grantee”). Each of Owner and Grantee is sometimes referred to as a “Party” and collectively as the “Parties.”
