This Settlement Agreement and Release (“Agreement”) is made and entered into on October 5, 2023, by and among the Settlement Class Representatives (as defined in Paragraph 34), for themselves and on behalf of the Settlement Class (as defined in Paragraphs 32 and 33), and Lincare Holdings Inc. (“Lincare” or “Defendant”) subject to Court approval as required by Rule 23 of the Federal Rules of Civil Procedure.
