This amendment is made to that certain Economic Incentive Agreement (the “Agreement”) entered into effective September 1, 2006, by and between the City of Euless, Texas, a home rule municipality organized and existing under the constitution and laws of the State of Texas, hereinafter referred to as “CITY”, and Burk Collins & Co., Ltd., a Texas Corporation, hereinafter referred to as “CURRENT DEVELOPER”, and Vineyard Village MSV, LLC, a Texas Limited Liability Company, an affiliate of Burk Collins & Co. Ltd., hereinafter referred to as “NEW DEVELOPER”, and is entered into as of the date last executed by any of the parties hereto, although effective as of the 2nd day of September, 2006.
