THIS AGREEMENT (“Contract”), is made and entered into as of the day of 2023 (“the effective date”) by and between Augusta, Georgia, a political subdivision of the State of Georgia (hereinafter referred to as “Augusta”), acting through the Housing and Community Development Department (hereinafter referred to as “HCD”) - with principal offices at 510 Fenwick Street, Augusta, Georgia 30901, as party of the first part, and CAPITALRISE (hereinafter referred to as “CAPITALRISE), a contractor and developer organized pursuant to the Laws of the State of Georgia, hereinafter called "CAPITALRISE, LLC” as party in the second part.
