This Infrastructure Development Agreement (this “Agreement”) is dated as of the day of , 2015 (the “Agreement Date”), by and between the BOARD OF SUPERVISORS OF FAIRFAX COUNTY, VIRGINIA, a body corporate and politic, in its proprietary capacity as the owner of certain land in Fairfax County, Virginia and not in its governmental or regulatory capacity (“Owner”) and WESLEY HAMEL LEWINSVILLE LLC, a Virginia limited liability company (together with its permitted successors and assigns, “Developer”) Owner and Developer are sometimes referred to individually as a “Party”, and collectively as, the “Parties” under this Agreement.
