This agreement establishes the terms and conditions under which the City of San Antonio, Texas acting by and through the Public Service Board ("CPS Energy"), a municipal utility of the City of San Antonio, may grant access to certain underground trenches to , a corporation of the state of (“Joint Trencher”) for the installation by Joint Trencher of its conduits, ducts, and facilities in such trenches (the “Agreement”), with such Agreement to be effective as of the date of execution by the last signatory hereto (the “Effective Date”). CPS Energy and Joint Trencher are collectively referred to herein as the “Parties” and sometimes individually referred to herein as a “Party.”
