THIS SETTLEMENT AGREEMENT AND RELEASE (“Agreement” or “Settlement”) is entered into by and between plaintiffs Andrea Durkee and Jerome Polvay (collectively, “the named Plaintiffs”), on behalf of themselves, and, in their representative capacities, on behalf of all other individuals and entities who are members of the class certified in the New York Action or the classes identified in the Complaintin the Nationwide Action, and defendant FCTI, Inc. (“FCTI” or “Defendant”) (each a “Party” and, collectively, the “Parties”).
