This Amendment No. 3 (“Third Amendment”) to the February 10, 2020, Exclusive Negotiating Agreement (“ENA”) between the Housing Authority of the City of Artesia (the “Housing Authority”), the City of Artesia (the “City”), and Glendale Commercial, Inc., a California corporation, (the “Developer”), effective November 1, 2021, is between the Housing Authority, City, and Developer. The Housing Authority, City and the Developer are sometimes individually referred to herein as a “Party” and are sometimes collectively referred to herein as the “Parties.”
