These Reseller Terms of Sale, including all applicable terms referenced herein, (collectively, this “Agreement”) applies to the purchase from Dell Computer (Pty) Ltd, Allandale Building, First Floor, 23 Magwa Crescent, Waterfall City, Johannesburg, 2090, South and its Affiliates (collectively, “Dell” or “Supplier”) for the resale of Dell Offerings to End Users in South Africa (see definition of “Territory” below). This Agreement is not applicable to the purchases of Dell Offerings for Partner’s own internal end use (in such case Dell’s Commercial Terms of Sale shall apply).
