This Agreement is made between Developer and Velocity Network Foundation, a Delaware nonprofit nonstock corporation (“Foundation”, and collectively with you, the “Parties,” or each individually, a “Party”), and notwithstanding anything to the contrary in any other document, agreement or arrangement between You and the Foundation or any third party or anyone on either’s behalf the terms of this Agreement shall govern the subject matter hereof. Developer assumes all responsibility for the selection of the Software, for Developer’s and others’ reliance on the results of its use of the Software and/or applications developed based on the Software and for any use of the Software not in accordance with the terms hereof.
