Oral agreements often become conflicts in the business world, especially when there is a default. Default occurs when one party does not fulfill its obligations in accordance with the mutual agreement. The existence of an oral agreement can complicate the dispute resolution process because it is difficult to prove an agreement between the parties involved. Therefore, the legal certainty of an oral agreement in the event of default needs to be understood carefully. The formulation of the problem discussed in this study is how to arrange oral agreements in the Civil Code and how to settle an oral agreement due to default. The research method used is normative legal research. The results of the study show that the Civil Code does recognize that oral agreements have legal force. However, legal certainty in an oral agreement becomes less clear because there is no clear written evidence regarding the contents of the agreement.
