time of delivery of the Products to the Ex Works point, ABioNova shall promptly deliver additional or substitute Products to Distributor in accordance with the delivery procedures set forth herein, provided however, that in no event shall ABioNova be liable for any additional costs, expenses or damages incurred by Distributor directly or indirectly as a result of such shortage, damage or discrepancy in or to a shipment.
