This Aprimo Access Agreement (“Access Agreement”) is entered into between Western Union Business Solutions (USA), LLC (“WUB S”) and the Client accepting such Access Agreement and is subject to and governed by the contractual provisions set forth herein. This Access Agreement supplements the Terms and Conditions to which Client has already agreed to be bound. This Access Agreement is intended to govern only the use of the Aprimo marketing platform, which is a third party service provided by Aprimo US LLC (“Aprimo”), as between WUBS and Client. All other provisions of the Terms and Conditions remain operative and are expressly incorporated by reference. Where there is a conflict between the terms of this Access Agreement and the Terms and Conditions, the terms of this Access Agreement shall control solely with respect to Client’s use of the Aprimo marketing platform to the extent of such conflict.
