This Class Action Settlement Agreement is entered into as of July 24, 2020, by and among Plaintiffs Molly Becker, Sonja Bolerjack, Allan Curry, Frank Gonzalez, Vincent Lebrecht, Maria McBain, Justin McHale, Victoria Rodgers, Pamela Smythe, and Robin White, individually and on behalf of the Settlement Class Members, on the one hand, and Defendants Massimo Zanetti Beverage USA, Inc. (“Massimo”), Mother Parker’s Tea & Coffee USA, Ltd. (“Mother Parkers”) and Reily Foods Company (“Reily” and, together with Massimo and Mother Parkers, the “Defendants”), on the other hand. Each of Plaintiffs and of Defendants shall be referred to herein individually as a “Party” and collectively as the “Parties.” Capitalized terms used herein are defined in Section II of this Settlement or indicated in parentheses elsewhere in this Agreement.
