(“ESCO”) and City of Lincoln, Nebraska (“Customer”), dated December 21, 2020 (the “Date of Commencement”) whereby ESCO agrees to provide and perform the energy conservation measures (“ECMs”) set forth in the Contract Documents including but not limited to the Schedules and Exhibit(s) listed below and incorporated fully herein, subject to the terms and conditions set forth herein:
