THIS AGREEMENT (“Agreement”) is made by and between NASDAQ Futures, Inc. (the “Exchange”), a Delaware corporation whose principal offices are located at One Liberty Plaza, 165 Broadway, New York, NY 10006, and (“Authorized Customer”), a whose principal offices are located at . The Exchange and each of its affiliates and subsidiaries that provide any portion of the Services (as defined below) to Authorized Customer hereunder, along with their officers, employees, and agents, are collectively referred to herein as “NASDAQ.” The Exchange and Authorized Customer are each individually a “Party” and collectively the “Parties.”
