THIS SETTLEMENT AGREEMENT (“Settlement Agreement”) is made and entered into as of the 28th day of July, 2021 (“Execution Date”) by and between the End-User Consumer Indirect Purchaser Plaintiffs (“EUCPs”),1 through Interim Lead Counsel2 for the proposed Settlement Class (as hereinafter defined), and Pilgrim’s Pride Corporation, and all of its predecessors; successors; assigns; affiliates; and any and all past, present, and future parents, owners, subsidiaries, divisions, departments (collectively referred to as “Settling Defendant” or “Pilgrim’s”) in the above-captioned action (the “Action”). EUCPs, on behalf of the Settlement Class, and Pilgrim’s are referred to herein collectively as the “Parties” or individually as a “Party.”
