This Data Processing Agreement (“DPA”) is entered into between Four Winds Interactive dba Poppulo and its Affiliates (“Poppulo”) and Customer (jointly, “the Parties”), and forms part of the Master Software Subscription Agreement (or other such titled agreement addressing the same subject matter) (“MSA”) between the Parties, and reflects the Parties’ agreement with regard to the Processing of Personal Data. Customer enters into this DPA on behalf of itself and, to the extent required under applicable laws, rules, regulations, and orders of governmental authorities having jurisdiction, in the name and on behalf of its Affiliates, if and to the extent Poppulo processes Personal Data for which such Affiliate qualifies as the Controller. All capitalized terms not defined herein shall have the meaning set forth in the MSA.
