This Data Protection Addendum (“Addendum”) is dated November 27, 2023 and is between School District No. 1 in the City and County of Denver and State of Colorado, d/b/a Denver Public Schools (“District”) and BrainPOP LLC (“Contractor”). This Addendum applies to all products and services provided by Contractor to District during the District’s applicable subscription, and pursuant to the Terms of Use and Privacy Policy as posted at www.brainpop.com and as updated from time to time (collectively, the “Contract” or “Terms of Use”) which govern the District’s use of Contractor’s products and services (hereinafter the “Services”). The Addendum and the Contract are collectively referred to hereinafter as “Agreement”. This Addendum is hereby incorporated into the Contract and shall amend certain terms of the Contract only as it applies to the District and the applicable subscription.
