This Amended And Restated Land Acquisition Agreement (this “Amendment”) is executed as of the day of , 2024 (the “Effective Date”), by and among TTRG IN Fishers Swordfish, LLC, a Delaware limited liability company (“Developer”), the City of Fishers Redevelopment Commission, a commission of the City authorized and existing pursuant to Ind. Code § 36-7-14 et. seq. (the “Commission”), and the City of Fishers, Hamilton County, Indiana (the “City” and together with the Commission and the Developer, the “Parties” or each a “Party”), on the following terms and conditions:
