As provided under RCW Title 39, Chapter 39.34, this Co-Location and Indemnity Agreement (the "Agreement") is by and between Washington State Department of Transportation, a political subdivision of the State of Washington, with offices located at 310 Maple Park Avenue SE, Olympia, WA 98504-7300 (hereinafter referred to as “Customer” or "WSDOT"), and Energy Northwest, a municipal corporation and joint operating agency of the State of Washington and doing business by and through its Business Development Fund, with its principal office at 3000 George Washington Way, Richland, WA 99354 (hereinafter “Energy Northwest” or “EN”).
