This Funding Agreement (the “Agreement”) is entered into as of , 2009 (the “Effective Date”) between the City of Kirksville, Missouri (the “City”) and Kirksville Shopping Center, LLC, a Missouri limited liability company (the “Developer”) (individually, a “Party”; collectively, the “Parties”).
