The Government of the United States of America and the Government of the Republic of Ecuador (individually a “Party” and collectively the “Parties”), having entered into the Agreement between the Government of the United States of America and the Government of the Republic of Ecuador Concerning a United States–Ecuador Council on Trade and Investment on 23 July 1990 (hereinafter referred to as the “Agreement”):
