SUBLETTING AGREEMENT

NOTE: Subletting means that the tenant allows someone else to live in the unit, but keeps all of the obligations he or she had to the landlord. This is most often done when the tenant plans to move back into the unit. A subletting is not valid unless the landlord gives written consent. Consent must not be unreasonably withheld. The consent to subletting may be in the approved form and must be signed by the landlord, the tenant and the subtenant. If a written tenancy agreement exists it must be attached to the subletting agreement. If the tenant thinks the landlord is unreasonably refusing to allow a subletting, he or she can apply to the rental officer, who will make a decision (Residential Tenancies Act sections 22, 23, 24).
