The General Terms and Conditions to the Financially-Settled Standard Offer Capacity Agreement (these “GTCs” and together with all Confirmations subject to these GTCs, collectively, the “Agreement”) is entered into effective as of the day of , 2011 (the “Effective Date”) by and between [Eligible Generator] (the “Generator”), and [NJ Public Utility] (“Utility”). Each of the Generator and Utility may also be referred to individually as a “Party” or collectively as the “Parties.” The definitions set forth in Appendix “1” shall apply to this Agreement.
