This Wired Telecommunications License (“License”) and Right-of-Way Use Agreement (“Agreement”) is effective as of this day of April, 2012, by and between the City of Tempe, an Arizona municipal corporation (“City”) and XO Communications Services, LLC f/k/a XO Communications Services, Inc. (“XO”), a Delaware limited liability company and subsidiary of XO Holdings, f/k/a XO Holdings, Inc.
