This Economic Development Agreement, (“Agreement”) made this day of July, 2024 (“Effective Date”) by and between the CITY OF FRANKLIN, an Indiana municipal corporation (“City”), the Franklin REDEVELOPMENT COMMISSION, as the governing body of the City of Franklin Redevelopment District, existing and authorized pursuant to Ind. Code36-7-14 et. seq., as amended (“RDC”) (collectively the RDC and the City are referred to as “City Parties”) and HERBERT MALARKEY ROOFING COMPANY, a for-profit foreign corporation organized and existing pursuant to the laws of the State of Oregon and admitted to do business in Indiana (“Malarkey”) (collectively City, RDC and Malarkey are referred to as “Parties”, individually “Party”).
