The Fair Credit Reporting Act, 15 U.S.C. 1681b, requires that businesses inform applicants or anyone for whom a background check is requested in a clear, conspicuous, separate disclosure of the business’ intent to obtain a consumer report on the applicant or volunteer. The Act further requires that the applicant or volunteer give his or her written authorization to obtain a consumer report.
