This Settlement Agreement and Release (“Settlement Agreement” or “Settlement”) is entered into by and between (i) EmergeOrtho, P.A. (“EmergeOrtho” or “Defendant”) and (ii) Daniel Green, (“Plaintiff”) both individually and on behalf of the Settlement Class (as defined below), in the case Green v. EmergeOrtho, P.A., Case No. 22CVS3533 in the Superior Court of Durham County, North Carolina. EmergeOrtho and Plaintiff are collectively referred to herein as the “Parties.” The lawsuit is referred to herein as the “Litigation.”
