User of any Nemaris Inc. (Nemaris) products or services including but not limited to Surgimap Spine, Surgimap ISSG, Surgimap SRS, Surgimap Office, Surgimap Ortho, Surgimap Access, acknowledges that it is a “Business Associate” of Nemaris as defined by the standards for Privacy of Individually Identifiable Health Information under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), as amended by Sections 13400 through 13424 of the Health Information Technology for Economic Clinical Health Act (the “HITECH Act”), which was enacted as part of the American Recovery and Reinvestment Act of 2009 (“ARRA”). In accordance with the terms set forth in this “Privacy Agreement”, User of Nemaris products or services and Nemaris shall use reasonable best efforts to protect the privacy of Protected Health Information.
