This Partner Data Processing Agreement (this “Agreement”) effective as of the last date signed below (“Effective Date”) entered into by and between Akamai Contracting Entity/Entities listed in the Channel Agreement (“Akamai”) and Partner Contracting Entity/Entities listed in the Channel Agreement (“Partner”), is incorporated into and made a part of the NetAlliance Partner Agreement, reseller agreement, channel partner agreement, or other agreement in effect between the parties allowing Partner to resell Akamai Services to its own customers ("Channel Agreement"), as the same may be or have been amended by the parties from time to time. If the provisions of this Agreement and the Channel Agreement conflict, including any previously executed or incorporated data protection agreement or privacy terms and conditions, then the provisions of this Agreement shall control. Except for any changes made by this Agreement, the Channel Agreement remain unchanged and in full force and effect.
