This Continuing Disclosure Agreement (the "Agreement"), dated as of __ 1, 2021, is executed and delivered by the Texas Department of Housing and Community Affairs (the "Department") and The Bank of New York Trust Mellon Company, N.A., as Trustee, in connection with the issuance of the Department's Single Family Mortgage Revenue Bonds, 2021 Series A (the “Series 2021A Bonds”) and Single Family Mortgage Revenue Refunding Bonds, 2021 Series B (Taxable) (Mortgage-Backed Securities Pass-Through Bonds (the “Series 2021B Bonds”) (collectively, the "Series 2021 Bonds"). The Series 2021 Bonds are being issued pursuant to an Amended and Restated Single Family Mortgage Revenue Bond Trust Indenture, dated as of June 1, 2017, between the Department and The Bank of New York Mellon Trust Company, N.A., as Trustee, Paying Agent, and Registrar for the Series 2021 Bonds issued by the Department thereunder (the "Trustee").
