Morgan Chase Bank, (hereinafter referred to as Trustee), amends, modifies and restates a certain Trust Agreement dated October 17, 2002, and April 2, 2004, by and between NYSARC, Inc. as Settlor and NYSARC, Inc. and a financial institution, J.P. Morgan Chase Bank (as was previously selected in Article V Section 5.1) as co-trustees.
